REGULATIONS OF THE CULTURAL HERITAGE CENTRE

I. GENERAL PROVISIONS

 1. The Cultural Heritage Centre (hereinafter – the Centre) is a budgetary cultural institution owned by the state.

2. The institution implementing the rights and obligations of the Centre's owner is the Department of Cultural Heritage under the Ministry of Culture (hereinafter – the Department of Cultural Heritage). The competency of the Department of Cultural Heritage in implementing the rights and obligations of the Centre's owner is governed by the Law on Budgetary Institutions of the Republic of Lithuania (Official Gazette, 1995, No. 104-2322; 2010, No. 15-699), Regulations of the Department of cultural Heritage of the Republic of Lithuania, approved by order No. ĮV-116 of the Minister of Culture of the Republic of Lithuania, dated April 1, 2005 (Official Gazette, 2005, No. 45-1474; 2010, No. 71-3598) and other legal acts of the Republic of Lithuania.

3. The Centre is a public legal entity with a bank account and a seal baring the state emblem of Lithuania and its name. Office address: Ašmena str. 10, LT-01135 Vilnius.

4. The activity of the Centre is based on the Law on the Protection of Immovable Cultural Heritage (Official Gazette, 1995, No. 3-37; 2004, No. 153-5571), the Law on the Protection of Movable Cultural Property (Official Gazette, 1996, No. 14-352; 2008, No. 81-3183), the Law on Libraries (Official Gazette, 1995, Nr. 51-1245; 2004, No. 120-4431), the Law on Budgetary Institutions (Official Gazette, 1995, No. 104-2322; 2010, No. 15-699), the Law on Budgeting (Official Gazette, 2001, No. 91-3190; 2008, No. 137-5378) and other laws of the Republic of Lithuania, resolutions of the Government of the Republic of Lithuania, the Regulations of the Centre and other legal acts.

5. Public announcements of the Centre are published in the website of the Department of Cultural Heritage.

6. The Regulations of the Centre are changed in accordance to the procedure indicated in Law on Budgetary Institutions of the Republic of Lithuania.

7. The assets of the Centre are managed, used and disposed under fiduciary law. The Centre is financed from state budget. Other funds acquired in accordance to statutory procedure may be used for financing the Centre.

 II. AIMS OF ACTIVITY AND FUNCTIONS OF THE CENTRE

 8. Activity aims of the Centre:

8.1. to collect data, necessary for inventory of cultural heritage, to manage the cultural heritage inventory;

8.2. to collect and manage data on cultural heritage.

9. The Centre performs the following functions in implementing the aims:

9.1. collects, revises and systemizes material information describing cultural heritage, and capturing of the present and the past;

9.2. performs historical and physical research (except for exploratory and detailed archaeological research) associated with cultural heritage, also collects, manages and prepares associated documents and information;

9.3. presents the data collected to the Department of Cultural Heritage;

9.4. performs the activity of a special heritage protection library.

 

III. RIGHTS AND OBLIGATIONS OF THE CENTRE

 

10. The Centre has the rights to:

10.1. form commissions for dealing with activity matters;

10.2. form work groups for preparing document projects;

10.3. determine the internal organizational structure;

10.4. conclude agreements;

10.5. submit proposals to the Department of Cultural Heritage and initiate the registration of cultural property in the Register of Cultural Property;

10.6. cooperate with municipal heritage protection subdivisions, structural subdivisions of the Department of Cultural Heritage and other heritage protection institutions;

10.7. present issues and associated documents for the agenda of to the Immovable Cultural Heritage Assessment Board of the Department of Cultural Heritage;

10.8. inform the public about the cultural heritage;

10.9. provide information to physical and legal entities within its competence in accordance to the procedure laid down by the Law on the Right to Obtain Information from State and Municipal Institutions;

10.10. establish a structural subdivision performing the activity of a special heritage protection library.

11. In implementing its functions, the Centre shall:

11.1. perform the activities specified in these Regulations;

11.2. present annual activity plans of the part performed by the Centre, as well as execution, financial reporting, budget execution, statistical and other reports to the Department of Cultural Heritage;

11.3. perform obligations under the agreements concluded by the Centre;

11.4. ensure the correctness of the Centre's financial reporting, budget execution, statistical and other reports;

11.5. use the funds received from the budget the Republic of Lithuania and other funds received in accordance to the provisions of law, resolutions of the Government of the Republic of Lithuania and other legal acts;

11.6. present the data on cultural property to the Department of Cultural Heritage;

12. The Centre may have other rights and obligations laid down by the laws and other legal acts.

 

IV. ORGANIZATION OF CENTRE ACTIVITY

 

13. The activity of the Centre is organized in accordance to the annual activity plan of the Department of Cultural Heritage approved by the Minister of Culture of the Republic of Lithuania and the annual activity plan of the Centre approved by the Director of the Department of Cultural Heritage.

14. Centre shall be led by the Director, who is appointed or dismissed by the Director of the Department of Cultural Heritage in accordance to the procedure laid down in the Labour code (Official Gazette, 2002, No. 64-2569) and other legal acts of the Republic of Lithuania. The Director of the Centre has a deputy.

15. The Director of the Centre:

15.1. leads the Centre and is responsible for all activities of the Centre;

15.2. approves the organizational structure and list of positions of the Centre in coordination with the Department of Cultural Heritage;

15.3. approves employee salaries and premiums without exceeding the funds allocated for salaries;

15.4. approves the regulations of structural subdivisions of the Centre and job descriptions in coordination with the Department of Cultural Heritage;

15.5. presents project cost and revenue estimates to be approved by the Department of Cultural Heritage;

15.6. employs and dismisses Centre employees, provides incentives and imposes disciplinary penalties;

15.7. signs agreements in coordination with the Department of Cultural Heritage;

15.8. signs letters, documents and provides authorisations;

15.9. approves the rules of procedure and other administrative documents of the Centre;

15.10. issues orders and other legal acts regulating the activities of the Centre approved by the orders, compulsory for all employees of the Centre and monitors their enforcement;

15.11. ensures that the Centre would perform activities in accordance to the provisions of law, enforced Government resolutions and other legal acts of the Republic of Lithuania, as well as orders of the Minister of Culture and the Director of the Department of Cultural Heritage;

15.12. is responsible for proper use and preservation of the Centre’s assets;

15.13. represents the Centre in courts and other law enforcement authorities without separate authorisation;

15.14. ensures rational and effective allocation of funds and state assets allocated for the Centre;

15.15. represents the Centre in state authorities in accordance to the procedure laid down by legal acts;

15.16. carries out the assignments of the Director of the Department of Cultural Heritage.

16. In the absence of the Centre’s Director his/her duties, under the order of the Director of the Department of Cultural Heritage, are performed by the Deputy Director of the Centre or the Head of the structural subdivision of the Centre.

17. The work relations and remuneration of the Director and employees of the Centre are regulated by the Labour code and other legal acts of the Republic of Lithuania.

 

V. INTERNAL ADMINISTRATION CONTROL OF THE CENTRE

 

18. Financial control of the Centre is performed by the Director of the Centre in accordance to the financial control rules of the Centre.

19. Annual activity plan implementation control is performed by the Department of Cultural Heritage.

20. Internal audit is performed by the Internal Audit Department of the Ministry of Culture of the Republic of Lithuania.

21. State audit is performed by the National Audit Office of the Republic of Lithuania.

 

VI. FINAL PROVISIONS

 

22. The Centre may be reorganized, restructured or liquidated in accordance to the procedure laid down by laws and other legal acts.
